Terms of Service
By working with FRTHR™ or using our website, you agree to the terms below.
These terms apply to all work carried out by FRTHR™, a trading name of Studio Braemar Ltd, registered in England and Wales (No. 12118238).
1. Scope of Work
Before any project begins, we'll agree on a written scope covering deliverables, timelines, and pricing. This will be outlined in a proposal, email, or project document.
If new tasks fall outside what was originally agreed, we'll requote and confirm with you before moving forward. You won't be surprised by new costs.
2. Payment Terms
Our standard terms are 50% upfront, 50% upon delivery, unless agreed otherwise in writing.
Final files are delivered after final payment is received. Late payments of more than 7 days may pause the project timeline.
We accept payment via bank transfer, or a payment link sent via Stripe.
3. Revisions
Every project includes a defined number of revision rounds, typically two to three per phase depending on scope.
Revisions are meant to refine, not restart. If feedback significantly changes direction after approvals have been given, additional work may be quoted. We'll always inform you before anything is billed.
4. Timelines and Deadlines
We set a clear schedule at the start of every project and commit to it, provided feedback, assets, and approvals are supplied on time by the client.
If a project goes without client response for more than 14 days, we'll pause the work. A rebooking fee may apply if we need to reschedule.
5. Ownership and Rights
Once final payment is received, you own the final deliverables, including designs, brand assets, and documentation created for your project.
We reserve the right to showcase completed work in our portfolio, case studies, or on social media unless you request otherwise in writing before the project begins.
Any work featured publicly will never include confidential business information, internal data, financials, or commercially sensitive material. We show the design work only. If the project itself is sensitive or involves a pre-launch brand, let us know upfront and we'll keep it private entirely.
6. Communication
We work primarily asynchronously, using email to stay aligned. We aim to respond to all project messages within 24 hours on weekdays. Where meetings are needed, we'll schedule them together.
7. Cancellations
You may cancel a project at any time. You'll be invoiced for work completed up to the point of cancellation.
Project bookings are confirmed via email and constitute an agreement to the scheduled dates and fees.
Where time has been specifically reserved, we require a minimum of 5 working days notice to cancel or reschedule without charge. Cancellations made with less than 5 working days notice may incur a cancellation fee of up to 50% of the scheduled work value. Cancellations made within 48 hours of the scheduled start date will be charged at 100%, as time set aside at short notice cannot reasonably be reallocated.
If a project is paused for more than 21 days without prior notice, we may reschedule the work depending on availability. A restart fee may apply depending on scope.
8. Liability
We deliver work as outlined in the agreed scope with professional care and in good faith. We are not liable for indirect damages, issues arising from third-party services such as hosting platforms or plugins, or how the final work is used beyond our control.
9. Confidentiality
Everything you share with us during a project - including strategy, financials, product details, or internal documentation - remains strictly private. We do not share, reuse, or disclose client information under any circumstances without your explicit permission.
We work under NDA as standard practice. A mutual non-disclosure agreement is usually signed before work begins on every project, ensuring complete confidentiality for both parties from day one.
10. Governing Law
These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
11. Updates to These Terms
We may update these terms from time to time. Continued engagement with FRTHR™ after any changes constitutes acceptance of the updated terms.
